Court Grants Rashid Echesa KSh 2 Million Bond, Bars DCI from Detaining Him
The High Court ordered the police not to arrest or detain Rashid Echesa, chairman of the Kenya Water Towers Agency, and granted him anticipatory release, so he is now free to attend to his business.
Orders were given by Justice Diana Kavedza after a declaration of urgency submitted by Echesa’s lawyer Danstan Omari.
The document states that the former Sports Cabinet Secretary, who is presently receiving treatment at Karen Hospital, needed a special diet.
Omari said that his health might be negatively affected by his ongoing detention.
“The continuous detention of the applicant shall prejudice his health as he is required to observe a particular diet while undergoing treatment, and he is required to report back to the the hospital,” the application stated.
Echesa claimed in his application that the DCI’s accusations of extortion and self-abduction were politically motivated and without merit.
“The allegations against the applicant remain unproven as he has not been officially charged, and even if he were to be charged, it is a bailable offence. On allegations of self-abduction, the applicant was arrested on March 27, 2024, while obeying lawful summons by the County criminal investigations officer,” the lawyer told the court.
According to what Echesa told the court, he was a sick person who needed to return to the hospital for follow-ups on a regularfollow-ups under his doctor’s orders.
Justice Kavedza then granted restraining orders prohibiting his detention by the police.
With a personal bond of KSh 2 million issued by the court, Echesa was ordered by the police to face charges prior to April 22, 2024.
“For the foregoing reasons, the court hereby issues orders in the following terms: the applicant be and is hereby admitted to bail pending a hearing of the application inter partes.
“That the applicant executes a personal bond of KSh 2 million. That pending hearing and determination of the application, the respondents, their servants, and/or agents, including law enforcement officers, are restrained and prohibited from arresting or detaining the applicant,” Kavedza directed.
Additionally, she issued a directive for Echesa to be accompanied to the DCI headquarters subsequent to his release from Karen Hospital.
In addition, she ruled that the police were permitted to pursue charges and sealed the file.
Thursday, March 28th, Echesa was apprehended on suspicion of self-abduction. Following his apprehension, he was detained at the Muthaiga Police Station before being hastily transported to the hospital.
