Ex MP Adan Haji Charged for illegally awarding his firm a tender worth 51M

Adan Haji Ali Sheikh, a former Member of Parliament for Mandera South, appeared before Mombasa Chief Magistrate Alex Ithuku on Tuesday, facing charges of unlawfully securing a contract worth Sh51,456,006 for his company.

The Office of the Director of Public Prosecution (ODPP) accused Ali of violating conflict of interest regulations outlined in Sections 42(3) and 48 of the Anti-Corruption and Economic Crimes Act 2003.

The prosecution alleges that during his tenure as an employee of the Kwale County Government, Ali awarded his hotel, Lofta Resort in Kwale, a catering contract totaling Sh51,456,006 between May 10, 2013, and May 10, 2017.

Ali, denying the charges, was granted bail set at Sh2,000,000, with a requirement for one surety of equivalent amount, or alternatively, a cash bail of Sh500,000.

The case, prosecuted by Peter Kiprop, Alex Gituma, and Victor Simbi, is scheduled for a pre-trial hearing on February 27, 2024.

Earlier, on February 5, the Ethics and Anti-Corruption Commission (EACC) had summoned Ali concerning the alleged misconduct.

The EACC claims that during his term as the Tourism County Executive Committee Member (CECM) in Kwale County from 2013 to 2017, Ali engaged in corrupt practices.

According to the EACC, Ali utilized his hotel, Lotfa Resort Diani Limited, owned by his wife and son, to conduct business with the County Government, offering accommodation and conference services at inflated rates.
