Kisii Politician To Be Buried After 9-Month Court Battle

The Court of Appeal has decided to release the body of former Borabu parliamentary aspirant Naftali Ontweka in Kisii County to his widow, Zipporah Masese Ondieki, for burial in Kamulu.

Ontweka passed away in April of the previous year.

There was a dispute between his widow, who wished to bury him in Kamulu, their matrimonial home, and his brothers, who preferred Kiango, Kisii County, where he also had a residence.

In its ruling, the Court of Appeal dismissed the appeal brought by the three brothers, stating that it lacked merit and was thus dismissed entirely.

Additionally, the court mentioned that the brothers are free to attend the burial and carry out the Gusii customary rites.

“For the avoidance of doubt, the body of the deceased shall be released to Zipporah Masese Ondieki, the respondent. The appellants are at liberty to attend burial and perform the Gusii customary rites,” reads the Court of Appeal decision.
