Saboti MP Caleb Amisi Sued By Diplomat Over Alleged Ksh.7M ‘Soft Loan
A formal complaint has been lodged against Caleb Amisi, a Member of Parliament for Saboti, on the grounds of purported non-repayment of “soft loans” of USD 60,300 (equivalent to around Ksh.7.9 million) that he acquired from a diplomat.
According to the diplomat, Josphat Machogu, their initial encounter occurred in June 2021 during Amisi’s official visit to IGAD offices in Djibouti, among other Members of Parliament.
Subsequently, they established a friendship, exchanged contact information, and maintained ongoing communication.
Machogu, represented by his lawyer Daniel Achach, asserts that Amisi approached him on various occasions from January 2022 to September 2022 and solicited soft loans of varying sums.
According to court documents, the initial sum disbursed to Amisi amounted to Ksh.500,000, which was purportedly transferred directly into his bank account on or around January 6, 2022.
The diplomat reported that on about April 12, 2022, he transmitted a further amount of USD 50,000 (equivalent to around Ksh.6 million) to the defendant.
In September, the petitioner asserts that Amisi made a formal request for an additional soft loan in order to address unanticipated expenses arising from the campaigns.
The defendant asserts that he provided Amisi with an extra sum of USD 10,300 (equivalent to approximately Ksh.1.3 million).
The ambassador, however, asserts that the Member of Parliament repaid a sum of Ksh.500,000 subsequent to his expression of intention to pursue legal recourse.
“The plaintiff prays for judgment against the Defendant for USD 60,300.00 and interest at court rates from the date of filing this suit until payment in full.” reads court papers.
According to his assertion, the Member of Parliament informed him that he was engaged in a campaign to reclaim his position in the National Assembly at the upcoming General Election.
The MP further highlighted his inability to generate sufficient funds through contributions and fundraisers, hence necessitating the acquisition of a refundable soft loan.
Additionally, he asserts that they had a mutual understanding that if the lawmaker emerged victorious in the elections and in office, they would repay all the soft loans that were provided in a single payment.
“In the alternative, the Defendant expressed to the Plaintiff that should he not win in the elections, he would give the Plaintiff a payment proposal that would be acceptable, but the Defendant was almost very sure of a win with the Plaintiffs soft loan,” reads the court papers.
According to the Ambassador, it has been stated that the Member of Parliament (MP) has allegedly defaulted on the soft loans provided to him by the Plaintiff, notwithstanding the Plaintiff’s compliance with his obligations under the agreement.
“I continue to suffer loss and damages… The Plaintiff made several attempts to reach out to the Defendant for the payment but the Defendant became evasive, slippery and also for a long period of time and when he finally did, the Defendant became abusive and threatening to the Plaintiff,” claims the diplomat.
According to the diplomat, the MP issued a warning of severe repercussions if he persists in insisting on the loan payment, which includes referring to the Plaintiff as ‘Kitakuramba’.
